MR. PRAVAT KUMAR PADHI, PRESIDENT:-
This C.C.Case No. 49/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
“Honbl’e Commission may direct the Ops be restrained from disconnecting power supply of the complainant’s residence and Rs. 20,000/- towards cost of litigation”.
Matter relates to Sec-126 of Electricity Act. As per the decision of Hon’ble Apex Court in the case of U.P. State Power Transmission Corporation –vrs- Md. Anis Ahmad. Consumer Commission has no power to entertain consumer complaint and as per Sec-42(5) of Electricity Act, 2003 there is grievance redressal Forum and as per Sect-127 there is Provision of Appeal. Hence we find no merit in the consumer complaint and accordingly the consumer complainant is dismissed.
Counsel for Complainant submitted that, he is a poor person and cannot move to various authorities and Courts and ready to pay the bill in installment and some discount may be given. Without expressing any opinion on the merit and suitability of the matter we hope and trust that if complainant makes an application to Ops the same shall be considered sympathetically and maximum rebate as due and admissible shall be given.
With the aforesaid observation & direction the C.C.Case No. 49/2023 along with I.A No. 24/2023 are hereby dismissed. No order as to cost.
