                         The present C.C.Case No. 3/2020 taken up today for order. Heard Ld. Counsel for the Complainant. Notice was duly served on the Opp.Parties. Non appeared on behalf of Opp.Parties after several dates posted for hearing. Hence, the Opp.Parties are set ex-parte.

                        The brief fact of the case is that deceased Brajabandhu Pati having three(3) sons and the present Complainant Rama Chandra Pati is one of  his son. Previously after death of deceased Brahabandhu Pati, all the three (3) sons were living jointly in mess and property under one roof. They were getting benefits equally from single electric connection and arrear accrued to a tune of Rs. 15,923/-, which were jointly used by the three (3) sons of the deceased. That, all the brothers are equally liable to pay their respective share in that arrear amount arosed during common use. At present other two brothers of the Complainant separated and constructed new dwelling house over the same plot and also availed new power supply from the Opp.Parties.

                                                                                             O R D E R

                     Perused carefully material available on record. It is a fit case to interfere for benefit of consumer. We accept the grievances put forth before us. The notice issued for disconnection on dt. 19.02.2015 liable to quashed and resultantly this is here by quashed. Further, direct that on payment of 1/3 of the arrear the Opp.Parties shall restore supply and also substitute the complainant name in place of deceased father. The Complaint is allowed and no order as to cost.

                          Issue extract of the order to the parties for compliance.
