Final Order / Judgement

MR. BIBEKANANDA DAS, MEMBER :-                      

                Complainant  has filed the C.C.Case U/S-12 of C.P.Act, 1986 seeking following relief, Honbl’e Commission after hearing from both parties direct the Ops to rectify the disputed previous amount Rs. 50,795/- and wave out to excess claim of Rs. 1120/- in disconnection notice. Further Ops are directed not to disconnect power supply to the Complainant’s premises those who are senior citizens and suffering from various diseases. Complainants are also prayed for compensation of 10,000/- & Rs. 2000/- for litigation cost.

               Brief fact of Complainants are that there is long pending outstanding from the time of the another of Complainant long back in 2003 and continuing from that date and prayed to waive out the entire pending dues.

                Notice to Ops were issued but none of the Opp.Parties appeared.

              Complainants are also continuously remained absent from 18/02/2020 and we could have dismiss for non prosecution but for just & proper adjudication and without assistance from both parties we dispose of the C.C.Case with the a direction to the Opp.Parties to receive the arrear deducting 30% of arrear as is being given by Ops, if the Complainant pays the entire dues within 45 days from the date of receipt of the order. With the aforesaid observation & direction the C.C.Case No. 4/2020 is disposed off  in Lok Adalat held today i.e. 08.07.2023.

                Issue extract of the order to the parties for compliance.

          Pronounced the Open Commission on this the 8th day of July, 2023.
