Jharendranath Sahoo filed a consumer case on 13 Oct 2022 against Executive Engineer CESU Jagatsinghpur & Others in the Jagatsinghapur Consumer Court. The case no is CC/130/2014 and the judgment uploaded on 18 Nov 2022.
JUDGMENT
Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking the following reliefs:
“Direct the opposite parties for supply of electric energy to the premises and give compensation”.
This Forum (Commission) vide order dtd.30.9.2014 in misc case No.64/2014 directed as under;
“Complainant filed a consumer complaint bearing No.130/2014 along with a misc case No.64/2014 U/s.13-3(B) of the C.P. Act with a prayer for a direction to supply temporary electricity line connection to his house till final disposal of the C.C.
Heard the learned counsel for the complainant ex-parte. Perused the documents found on record. Considering the facts and circumstances of the case, the misc case is allowed. The opposite parties are directed to supply temporary domestic electricity line connection to the house of the complainant within 03 (three) days from receiving of this order by maintaining all paraphernalia required for the same till further order.”
Counsels for both sides are absent, this is a year old case of 2014 and we have no assistance from both sides. We have gone through the records and found that there is discrepancy with respect to plot number as the complainant has given application for service connection in plot No.498 but in the complaint petition complainant mentioned plot No.500 and 501. One Saroj Kumar Sahoo the Co-owner of the plot has raised objection and he has raised objection before opposite parties that complainant is liable to pay partial arrear in respect of consumer No.03133436, which was also utilized by the complainant. We are in dark regarding the supply of new connection as per our order dtd.30.9.2014. The opposite parties have claimed Rs.79,172.74 as on September, 2014.
We have applied our mind judiciously to the case of both sides and direct the complainant to make an application to opposite parties to settle the matter and determine his share and liabilities for payment of arrear dues in respect of consumer No.03133436.
The complainant shall pay 20% of the pending arrear and rest amount after settlement with the opposite parties shall be paid in 10 (ten) monthly installments. With the aforesaid observation and direction the consumer complaint is dispose of. No cost.
