Case is posted today for hearing on Admission.
Complainant present personally and argued on the admission of his case.
Heard the matter and on perusal of the Complaint petition and the documents available with it such as the final order of this Forum vide C.C.No. 3/2017 passed on Dt. 01/09/2017 and the disconnection notice issued by the Opposite Party Dt. 31/10/2019 with regard to the Electricity Consumer No. 512122160023 stands in the name of the father of the Complainant i.e. Lt. Sarat Chandra Mahapatra etc.
Having gone through the Complaint petition and the order passed by this Forum Dt. 01/09/2017, it is observed that the same point of issue was raised before the Forum in the said C.C.No.03/2017 and the matter was disposed off on Dt. 01/09/2017 as final order. Wherein the mother namely Lt. Laxmi Mahapatra was the Complainant. But in the present case the Complainant being the son and successor of the Complainant has filed the case, but for the same cause of action which was dealt with in the aforesaid C.C.Case and its Order.
In view of such fact and circumstances of the present case in relation to the aforesaid matter we do not find any reason to admit the case because the same cause of action can't be adjudicated for the second time in the same Forum.
Hence, the C.C.Case filed by the Complainant is rejected, not being admissible as per law.
The petition is rejected here.
