JUDGMENT

1. The present complaint has been filed by the complainant before this commission for  cancellation of the amount Rs.38574/ and to direct the op to release the electricity bills of domestic and commercial connection separately as per meter reading.

The Complainant has stated that he has the electricity LMV1 domestic connection of 2KW bearing connection no. 4698049362 and another connection no.8167713681 for commercial purpose of 1KW in the name of his brother Ranjeet Singh. Both the connections have separate meter. The Op had wrongly issued notice stating that the domestic connection was being used as commercial connection. In the checking report 433/06 dated 11.12.2020  it was wrongly mentioned that connection no. 4698049362 was being used and commercial connection no. 8167713681 was not malafidely  mentioned in the checking report. The alleged notice based on checking report is against law and the amount Rs.38574/ mentioned therein is liable to be cancelled.
3.  Op submitted in WS that the connection no. 4698049362 sanctioned in the name of Hoshiyar Singh for domestic use was found being used for commercial purpose in the shop as per report no.433/06 dated 11.12.2020. The complainant has mentioned the connection no. 8167713681 sanctioned in the name of Ranjeet Singh. 
4. Complainant has filed his affidavit and papers in support of his pleadings.  Op has also filed his affidavit and papers  in support of his pleadings
5. We have perused the material available on record and heard the parties  counsel.
6. The first question of consideration before us is whether the complainant is entitled to any relief?

It appears from perusal of record that the electricity connection no.4698049362 for domestic use sanctioned in the name of Hoshiyar Singh is install at the premises  chauraha Delhi gate, Aligarh as per electricity bill dated 6.9.2021 filed by the complainant and another connection no. 8167713681 for commercial use sectioned in name of Ranjeet Singh is installed at the premises 1569 Khitikan Mohalla Govind Singh Bhawan ke samane Aligarh as per electricity bill dated 6.9.2021 filed by the complainant. It is clear that both the electricity connections are installed at different premises and both the connection are not installed at the same premises. Therefore at the time of checking of connection pertaining to Hoshiyar Singh, the electricity connection in the name of Ranjeet Singh installed at different premises cannot be said take into consideration at the time of checking and plea of complainant to the effect that the commercial electricity connection sanctioned in the name of Ranjeet Singh was not taken into consideration at the time of checking. Thus the bill raised by the OP on the basis of checking report amounting Rs.38574/ cannot be cancelled. The electricity bills are being raised separately for the each electricity connection. Under the circumstances complainant is not entitled to any relief.           
8.   The question formulated above against the  complainant.
9.   We hereby dismissed the complaint.
10. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
