Shri S.K. Ojha, Member :- The brief facts of the complaint case is that, the complainant is a consumer of the O.Ps. bearing Consumer No. 413123030081 and was paying the electricity bills regularly. There was an old meter installed in the house of complainant which was defective one about which the complainant informed to the O.Ps. but the O.Ps. were issuing provisional bills. Issuing the provisional bills was continued after replacement of defective meter which were not corrected after several requests. All of sudden on dtd.27.02.2016 the O.Ps disconnected the electricity supply illegally, hence this case.
The O.Ps. were noticed. The O.Ps appeared and filed Written Version through their counsel admitting the facts of electricity connection and submitted that the complainant is a consumer vide consumer No. 413123030081 of 2KW load under domestic category. Till January,2015 there was no defect in the meter and the bills were raising on actual consumption and there was arrear of Rs.86,073/- only. From February,2015 to January,2016 there was heavy consumption between 1205 units to 2166 units and house lock reason provisional billing was made. On dtd. 24.02.2016 one demand cum-disconnection notice was served payment of arrear of Rs.1,70,529/- only but the complainant neither paid the same nor intimated for any correction of the bill and filed this complaint to avoid his liability. On direction through interim order of this Hon’ble Forum the O.Ps. complied on the same immediately, verified the facts and take sincere step to ascertain required correction of bills of complainant for the entire period from February,2015 to January,2016 and revised the bill from Rs.1,62,715/- only to Rs.1,08,087/- only till May,2016 and afterwards there is no fault left in the bill of complainant. The O.Ps. denying in any allegation of complainant and prayed for dismissal of the case.
Heard the matter, perused the case record and gone through the materials available. The complainant was having arrear dues of Rs.86,073/- only as on January,2015 up to which the electric meter was in O.K. condition and bills were raising on actual consumption but after February,2015 the bills were raising by the O.Ps. calculating on provisional basis which extended to Rs.1,62,715/- only up to January,2016. Later the provisional bills were revised by the O.Ps. and withdrawn Rs.68,911/- only from the total arrear bill of Rs.1,69,999/- only and it reduced upto Rs.1,01,087/- only up to May’ 2016.
As the O.Ps. were issuing the provisional bills to the complainant but on request they have revised the same. Here in this case in one side the O.Ps. issued provisional bills but rectified the same, in the other side the complainant is also liable to pay the said revised bills.
As per the above mentioned facts and circumstances we are in considered opinion to allow partly of the complaint case. Hence, we direct the O.Ps. to issue afresh electricity bill in favour of the complainant within 30 (thirty) days from the date of receipt of this order and receive the same bill amount in 10 (ten) numbers of equal monthly installments along with forth coming regular electricity bills.]
Accordingly the case is disposed of.
Order pronounced in the open court today the 27th day of February” 2017 and copy of this order shall be supplied to the parties as per rule.
