None has appeared on behalf of the appellant inspite of several calls.

Learned counsel Smt. Shashi Yogeshwar for respondent has appeared.

A perusal of the previous order indicates that the alleged legal heir Smt. Priyanka Berry of Sh. Ramesh Berry (deceased) has not filed adoption deed in support of her version as being legal heir of deceased.

As per the previous order, it was ordered that in absence of not filing the adoption deed, an adverse inference shall be drawn against the legal heir of the appellant.

Today, neither any document in support of legal heir of deceased has been filed, nor anyone has appeared to contest the appeal on behalf of the appellant.

Hence, in such circumstances and in the absence of alleged legal heir of the deceased – appellant, the appeal is hereby dismissed. No order as to costs.

Original record be remitted back to the concerned District Commission with the copy of this order for perusal and necessary information.

                        File be consigned to the record room alongwith copy of this order.
