Present :-          Complainants with Shri S.P. Singh advocate.

                    OP ex-parte.

                    During hearing it revealed that total sale price of the floor is Rs.1,13,50,000 (Rs. One crore thirteen lakhs fifty thousands). Learned counsel for the complainant submitted that Hon’ble National Commission in order dated 07.10.2016 passed in appeal no.644/2015 titled Parikshit Parashar V/S M/S Universal Buildwell Pvt.Ltd. and others has held that for the purpose of pecuniary jurisdiction total sale price of the property is to be seen.

          He further submitted that total sale price of the floor in dispute is more than Rs.1,50,00000/-. Therefore, this forum has no pecuniary jurisdiction to entertain and try the complaint. The complaint may be returned for presentation before Hon’ble National Commission having jurisdiction to hear the complaint.

          In view of above facts and circumstances and dictum of the Hon’ble National Commission in Parikshit Parashar’s case (supra) this forum has no pecuniary jurisdiction to decide this complaint.

                    Therefore, complaint be returned to the complainant for presentation before the Hon’ble State Commission. File be consigned to record room.
