Hd. the Ld. Advocate in full.  Perused the complaint and the Xerox copy of documents so filed by the complainant.

The case of the complainant in brief, is that, he wanted to purchase one flat measuring 1BHK at Nature City a Rajarhat Project ‘ËVANIE NATURE CITY” and paid Rs.30,000/- through HDFC Bank, Kaliaganj Branch. But after visit of the place the said project is not requirement as per his demand and he wanted to refund of the said money.

There is no such document i.e agreement to sale or purchase of the flat in between the complainant and the O.P has not been filed. According to provision of West Bengal Housing Industry Regulation Act, 2017 the matter of purchase or sale of housing sector particularly flat the West Bengal Housing Industry Appellate Tribunal has the jurisdiction.

Under the above facts and circumstances we are of the opinion that this Commission has no jurisdiction to entertain the complaint and as such the case is not admitted. Thus the case is disposed of.
