ORDER

 

SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  The opposite party entered appearance and filed written version denying the allegation raised by the complainant.  When the case came up for consideration on 25/03/2023, both parties submitted that there is a possibility of settlement and hence the matter was referred for mediation.  When the case came up for consideration today both parties filed a memo stating that the matter is settled.  As per the terms of compromise the opposite party has agreed to rectify the defects of the product and also agreed to pay Rs.9,000/- as compensation.  In the compromise memo, it is stated that the defects of the product were already rectified and an amount of Rs.9,000/- has been paid to the complainant by the opposite party vide DD No.971326 dated 25/04/2023 of Axis Bank.  The compromise memo is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.

In the result the complaint is dismissed as settled.  There will be no order as to cost.                  

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
