BEFORE THE LOK ADALAT HELD IN DISTRICT CONSUMER DISPUTES REDRESSAL FORUM–II, U.T. CHANDIGARH Consumer Complaint No.515 of 2012 Chandan Sharma Vs. Eureka Forbes Limited PRESENT: Complainant in person alongwith his counsel Sh.Jagjit Singh, Advocate. Sh.Parkash Chand, Authorized Agent of OP. Dated the 23rd day of November, 2012 ORDER 1. A compromise has been arrived at between the parties with the efforts of Lok Adalat. 2. Sh.Parkash Chand has filed his authorization letter on behalf of OP and made the following statement, recorded separately:- “The OP offers to refund the invoice price of Aquaguard i.e. Rs.17,900/- to the complainant in full and final settlement of the dispute, provided the complainant returns the Aquaguard in question. The above said amount shall be paid within 30 days from today” 3. The complainant, alongwith his counsel, made the following statement, recorded separately:- “I have heard the above statement made by OP. I accept the offer. I will return the Aquaguard in question to the OP on receipt of the cheque/payment. The case may be disposed of accordingly.” 4. In view of the statements made by the parties, it is ordered that OP shall refund the invoice price of Aquaguard i.e. Rs.17,900/- to the complainant in full and final settlement of the dispute, within 45 days from today. The complainant will return the Aquaguard in question to the OP on receipt of the cheque/payment. If OP fails to refund the invoice price of Rs.17,900/- within 45 days from today, they shall be liable to pay the said amount alongwith interest @ 18% p.a. from the date of this order till the date of payment. 5. Hence, the complaint is disposed of accordingly. 6. Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
