O R D E R

PER: NARESH KATYAL, JUDICIAL MEMBER:

Today the case was fixed for recording of evidence of complainant, subject to last opportunity.

2.                Case called twice since morning, but none has put in appearance on behalf of complainant even today to lead evidence. Perusal of file shows that from the last four dates, starting from 03.04.2023, none is appearing on behalf of complainant. Today is the 5th opportunity meant for leading evidence of the complainant.

3.                It appears that complainant is not interested to prosecute this complaint case.  This Commission does not find any reason to adjourn the case for the same purpose, again and again, despite last opportunity.

4.                It is already 2.00 P.M.  Waited sufficiently. Further wait is quite unjustified. So, the appeal is dismissed in default for want of prosecution.

5.                Application(s), pending, if any, stand disposed off accordingly in terms of this order.

6.                File be consigned to record room along with a copy of this order.

Pronounced on 29th February, 2024
