The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. Briefly the facts of the complaint are that the complainant purchased Samsung AC from OP-1 for a sum of Rs. 50,700/-. The technicians of OP-2 from the authorized service centre were unable to install the AC properly which resulted in certain defaults regarding cooling issues. The complainant several times approached OPs but to no effect. Hence, she filed present complaint for refund of the invoice amount of the disputed AC, installation charges and compensation on account of harassment.
After notice OP-2 appeared and filed reply to the complaint denying the allegation of the complainant. Both the parties filed affidavit of evidence alongwith written arguments.
During the proceedings the complainant appraised the forum that the OP has refunded the amount and now the complaint is only for compensation.
Though the matter stood settled between the parties but the complainant has not mentioned as to on which date the matter stood settled but it seems from the order sheet dated 22.04.2018 that amount has been refunded before 22.04.2018. Nevertheless the present complaint was filed in June, 2016 and it took nearly two years for OPs to resolve the issue for which we feel that the complainant should be reasonably compensated. Therefore we pass an award of Rs. 7,000/- in favour of complainant and against OPs towards harassment and litigation expenses.
