                          Complainant counsel is present . The council submitted. The petitioner is a B- class       contractor,  So is a consumer.

      Perused the record and relative document. Revealed admittedly the petitioner are B- CLASS  contractor. It is settled principle contractors are service providers . The person obtains goods for resale and commercial purpose so we do not consider the contractor is within the purview  of the definition u/s.2(d)(i)(ii) of the C.P. Act.

              Further revealed the case is barred by limitation and Vakalatnama was filed in incomplete, solely on executants signature only, besides with other defects. Hence the case does not come under the purview of consumer protection Act. So , same is hereby  rejected under sub-section 3 of the section 12 of the C.P. Act, 1986, hare with.
