Final Order / Judgement

C.C. No.664 of 2018                                                                      (16)

Present:-    None for the complainants.

Mr. Sanjeev Sharma, counsel for the opposite parties.

Today, again none has put in appearance on behalf of complainants, just like for the last two consecutive occasions none has appeared. If we look at the record after contesting opposite parties submitted their written version way back on 26.11.2019, ever since then one opportunity was availed by the complainants to lead evidence on 11.02.2020 and thereafter even if we leave the Covid-19 period and afterwards when regular functioning of the court starting from March, 2022 onwards, as many as 4 opportunities were availed by the complainants to do the needful in this regard, but still learned counsel for the complainants have failed to lead any evidence. Even, on certain occasions, learned counsel for the complainant even did not bother to appear before this Commission itself what to talk of leading any evidence. Keeping in view all this chronology of things, last opportunity was granted to the complainants to lead its evidence on 13.03.2023 and today as already observed again nobody has appeared on behalf of the complainants. From this entire history brought forth, it sems that complainants are no longer interested to continue with the present complaint, that is why he is not inclined to lead the evidence in support thereof. As such, no useful purpose will be served by adjourning this complaint further for the same very purpose. Case called several times since morning. It is already 1:30 P.M. Waited sufficiently. No further wait is justified. Hence, present complainant is hereby dismissed in default for want of prosecution. File be consigned to the record room.
