ORDER

1.   Vide her separate statement already recorded on 15.05.2024, Ms.Kavita Arora, Counsel for Complainant/DH has clarified that Sh.Gurpreet Singh Sidhu, JD/Accused No.3, is the Managing Director of JD No.1 & 2 Company and prayed that proceedings against JD No.1 & 2 be executed against JD/Accused No.3.

2.   Proclamation under Section 82 Cr.P.C. 1973 against accused No.3 Managing Director Gurpreet Singh Sidhu, C/o M/s Emerging Valley (P) Ltd. a unit of Emerging India Housing Corporation (P) Ltd., R/o House No.208, Sector 9, Chandigarh, has been duly affixed by Constable Anuj Kumar, Belt No.4665/CP, PO & Summon Staff, U.T. Chandigarh. Statement of Serving Constable has been recorded separately. Accused No.3 namely Gurpreet Singh Sidhu, Managing Director, M/s Emerging Valley (P) Ltd. a unit of Emerging India Housing Corporation (P) Ltd. has not appeared despite affixation of the proclamation. Hence accused person namely Gurpreet Singh Sidhu (Accused No.3), being Managing Director of JD No.1 & 2 Company M/s Emerging Valley (P) Ltd. a unit of Emerging India Housing Corporation (P) Ltd. is hereby declared Proclaimed Offender. 

3.   Let copy of this order be sent to the Incharge, P.O. & Summon Staff, Dhanas, Chandigarh, with the direction that name of aforesaid accused person namely Gurpreet Singh Sidhu (Accused No.3), being Managing Director of JD No.1 & 2 Company M/s Emerging Valley (P) Ltd. a unit of Emerging India Housing Corporation (P) Ltd. be got entered in the concerned proclaimed offender register of the police station concerned under intimation to this Commission and his arrest be monitored and as & when arrested be produced before this Commission forthwith.

4.   From the above, we are satisfied that accused person has absconded and there is no immediate prospects of his being arrested in near future. This being situation, let this execution be consigned to the record room with the remarks that it be kept in 50 years bundle and proceedings to be revived as & when accused person is arrested and produced before this Commission, in the capacity of Judicial Magistrate Ist Class, by the police. The complainant/DH is left at liberty to revive the proceedings in the execution as and when accused is arrested & produced or surrendered before this Commission.
