1. Rajinder Singh, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he invested an amount of Rs.24000/- with OPs in 12 installments of Rs.2000/- each and OPs issued registration letter/ policy number RP00007000061 dated 23.09.2010 which was to be matured on 22.09.2016 and Ops had to repay an amount of Rs.36,163/-. After the maturity date, the complainant approached the OP no.2 to release the maturity amount but OPs have been putting off the matter on one pretext or the other. Later on the Ops only deposited Rs.6000/- in the account of the complainant and remaining amount of Rs.30163/- is still due towards the OPs. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-
i) OPs be directed to pay Rs.30163/- along with interest @18% per annum from the date of maturity till realization,
ii) OPs be directed to pay to the complainant a sum of Rs.50,000/- on account mental agony and harassment and litigation expenses.
2. Notices were sent to the OPs but none has appeared for the OPs despite service. As such OPs were proceeded exparte.
3. The complainant has tendered documents Ex.C-1 to Ex.C-12 and closed evidence.
4. From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that it is the case of the complainant that he invested an amount of Rs.24000/- with OPs in 12 installments of Rs.2000/- each and OPs issued registration letter/ policy number RP0007000061 dated 23.09.2010 which was to be matured on 22.09.2016 and OPs had to repay an amount of Rs.36,163/- which is evident from document Ex.C-2 on record . The date of maturity of the plan was 22.09.2016. After the maturity date, the complainant requested the OPs to release the maturity amount and they only deposited Rs.6000/- in the account of the complainant but the OPs have not released the remaining maturity amount till date. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte.
5. For the reasons recorded above, we allow the complaint and direct the OPs to pay to the complainant an amount of Rs.30163/- alongwith interest @9% per annum from the date of filing of the complaint till realization. We further order the OPs to pay to the complainant an amount of Rs.3500/- on account mental pain agony and harassment and Rs.1500/- as litigation expenses.
6. This order of ours shall be complied with within 60 days from the date of receipt of copy of the order. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
