1.             Ravinder Singh, complainant preferred the present complaint against the OPs ( referred to as OPs in short) on the ground that he invested an amount of Rs.20,000/-  with OPs   vide certificate number  003986 on 18.11.2010 under  Single Premium Plan (SP) for a period of six years. The date of maturity of the plan was 17.11.2016. After the maturity date, the complainant surrendered the said certificate on 14.12.2016 at Sangrur and demanded the maturity amount i.e. Rs.40,000/-.  The OP no.2 issued  a receipt/ acknowledgement on the back of the photostat copy of the said certificate. The OP no.1 has started  working in the name of OP no.2 as has been told to the complainant by the OP no.2.  The OPs had closed their branch office at Sangrur.  The complainant approached the OPs for release of the amount but the OPs put off the matter on one pretext or the other. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:- 

i)      OPs be directed to release the maturity amount of Rs.40,000/- along with interest @18% per annum from 17.11.2016 till realization of entire amount,

ii)     OPs be directed to pay to the complainant a sum of Rs.10,000/- on account mental tension, agony, pain and harassment and  to pay Rs.7500/- as litigation expenses.

2.             Notices were sent to the OPs but none has appeared for the OP no.2 despite service. As such, OP no.2 was proceeded exparte. Earlier Shri Parul Chawla, Advocate had appeared for OP no.1, but he had not produced any reply and power of attorney on behalf of the OP no.1 and as such OP no.1 was also proceeded exparte.  

3.             The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.

4.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the case of the complainant is that he invested an amount of Rs.20,000/- with OPs   vide  certificate number  SP 003986 on 18.11.2010 under  Single Premium Plan (SP) for a period of six years and  the date of maturity of the plan was 17.11.2016 which is evident from the policy document Ex.C-1. After the maturity date, the complainant approached the OPs and surrendered the said certificate with OP no.2 and demanded the maturity amount but the OPs put off  the matter on one pretext or the other till today. After the maturity date, the OPs have not released the maturity amount till date. The OPs have not come forward to contest the case of the complainant rather the OPs choose to remain ex-parte. As such the evidence produced by the complainant has gone unrebutted on record.

5.             For the reasons recorded above, we allow the complaint and direct the OPs to pay to the complainant an amount of Rs.40,000/- alongwith interest @9% per annum from the date of submission of documents with the OPs i.e. 14.12.2016 till realization. We further order the OPs to pay to the complainant an amount of Rs.2500/- on account mental pain agony and harassment and litigation expenses.       

6.             This order of ours shall be complied with within 60 days from the date of receipt of copy of the order. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
