1. Sonia Rani, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that she invested an amount of Rs.5000/- with OPs vide account number SP 0018000022 on 06.11.2010 under Single Premium Plan (SP) for a period of 18 years. After maturity the OPs had to repay an amount of Rs.50,000/-. But, in the month of November 2016 the complainant requested the OPs to release the amount as she was in dire need of same. The complainant also submitted original policy and relevant documents with OP no.1 to release the amount and OP no.1 issued an acknowledgment dated 22.11.2016. Thereafter the complainant requested the OPs so many times to release the amount but they have been putting off the matter on one pretext or the other. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-
i) OPs be directed to release the amount of Rs.5,000/- along with upto date interest @18% per annum from the date of opening account till realization,
ii) OPs be directed to pay to the complainant a sum of Rs.50,000/- on account mental agony and harassment and litigation expenses.
2. Notices were sent to the OPs but none has appeared for the OPs despite service. As such OPs were proceeded exparte.
3. The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.
4. From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that it is the case of the complainant that she invested an amount of Rs.5000/- with OPs vide account number SP 0018000022 on 06.11.2010 under Single Premium Plan (SP) for a period for a period of 18 years which is Ex.C-2 on record . After the maturity date, the OPs had to repay an amount of Rs.50,000/- but in the month of November 2016 complainant requested the OPs to release the deposited amount as she was in dire need of money. She also submitted the original policy document with the OPs for which they issued acknowledgement/ receipt which is Ex.C-3 on record. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte.
5. For the reasons recorded above, we allow the complaint and direct the OPs to pay to the complainant an amount of Rs.5000/- alongwith interest @6% per annum from the date of deposit of the amount till realization. We further order the OPs to pay to the complainant a consolidated amount of compensation of Rs.2000/- on account mental pain agony and harassment and litigation expenses.
6. This order of ours shall be complied with within 60 days from the date of receipt of copy of the order. A copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
