1.             Lalit, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he  invested an amount of Rs.68220/-  with OPs  vide registration  number RP 0017000056  on  01.02.2011 which was to be matured on 09.02.2017. On maturity, the OPs had to repay an amount of Rs.1,05,284/- as maturity amount. Due to unavoidable circumstances, the complainant could not deposit the policy amount i.e. Rs.68220/- and had only paid Rs.33000/-.  After the maturity date i.e. on 10.04.2017 the complainant submitted original registration certificate and fulfilled all the formalities for releasing the maturity amount. Thereafter the complainant requested the OPs so many times to release the above said maturity amount but they have been putting off the matter on one pretext or the other.  The OPs did not release the maturity amount till today. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:- 

i)      OPs be directed to pay Rs.33000/- along with upto date interest @12% per annum from 09.02.2017 till realization,

ii)     OPs be directed to pay to the complainant a sum of Rs.20000/- on account unfair trade practice and Rs.20,000/- on account of mental torture, agony and inconvenience and Rs. 20000/- as litigation expenses.

2.             In reply filed by the OP no.2, it is stated that the complainant filed the present complaint on the basis of policy which is policy of the OPs. The complainant filed the complaint by concealing the facts from the Hon'ble Forum. There is no deficiency in service or unfair trade practice.

3.             OPs no. 1 had been given up by the complainant and OP no.3 was proceeded exparte.  

4.             The complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence. Despite affording opportunities to the OPs, no evidence has been produced even nor filed vakaltnama on behalf of the OPs and as such on 16.10.2017 OP no.2 was also proceeded exparte.

5.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant,  we find  that it is the case of the complainant that he  obtained a policy bearing registration  number RP 0017000056  on  01.02.2011 which was to be matured on 09.02.2017 and on maturity, the OPs had to repay an amount of Rs.1,05,284/- as maturity amount but due to unavoidable circumstances, the complainant could not deposit the policy amount i.e. Rs.68220/- and had only paid Rs.33000/-.  After the maturity date i.e. on 10.04.2017 the complainant submitted original registration certificate and fulfilled all the formalities for releasing the deposited amount of Rs.33000/- but the OPs did not pay the same till today. Surprisingly, the complainant has not produced on record any documentary evidence muchless receipts of payments which show that he deposited only an amount of Rs.33000/-. So, without any proof  it is difficult to  ascertain that the complainant has deposited Rs.33000/- with OPs when the OPs have specifically denied receipt of any payment and issuance of any policy.    

5.             For the reasons recorded above, we dismiss the complaint .  Copy of the order be supplied to the parties free of charge. File be consigned to records in due course.
