ORDER:

1.             Gurminder Kaur, complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that she   opened  an account number SP0007000093 dated 15.10.2010 of Rs.75000/-  under Single Premium Plan  ( SP) for  a period of six years from the OPs which was to be matured on 14.10.2016 . On maturity the OPs had to pay an amount of Rs.1,50,000/- .The complainant obtained another same plan  by depositing Rs.1,00,000/- vide  account number SP0007000118 dated 11.11.2010 for six years.  After maturity the OPs had to repay an amount of Rs.2,00,000/-.After maturity of the scheme, the complainant submitted original registration certificates/ policy  and fulfilled all the formalities for releasing the maturity amount. The OP no.1 issued /gave an acknowledgement dated 21.11.2016.  Thereafter the complainant requested the OPs so many times to release the above said maturity amount but they have been putting off the matter on one pretext or the other.  The OPs did not release the amount till today. Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-

i)      OPs be directed to make/ release the maturity amount of Rs.3,50,000/- along with interest @18% per annum from the date of maturity till its realization

ii)     OPs be directed to pay to the complainant a sum of Rs.50000/- on account of deficiency in service and  litigation expenses.

2.             Notices were sent to the OPs but despite service OPs have not appeared and as such OPs were proceeded exparte.

3.             The complainant has tendered documents Ex.C-1 to Ex.C-7 and closed evidence.

4.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant has alleged that she  opened  an account number SP0007000093 dated 15.10.2010 of Rs.75000/-  under Single Premium Plan  ( SP) for  a period of six years from the OPs which was to be matured on 14.10.2016 . On maturity the OPs had to pay an amount of Rs.1,50,000/- .The complainant obtained another same plan  by depositing Rs.1,00,000/- vide  account number SP0007000118 dated 11.11.2010 for six years and after maturity the OPs had to repay an amount of Rs.2,00,000/- which is evident from the  copies of registration certificates Ex.C-3 and Ex.C-4 which are duly stamped by the OPs.  To prove her case, the complainant has produced on record copies of applications/letters Ex.C-5 and Ex.C-6 which were also duly signed and stamped by the OPs. The OPs have not come forward to contest the case of the complainant rather they chosen to remain exparte.

5.             For the reasons recorded above, we find that the complainant well proved her case. Hence, we allow the complaint and direct the OPs to make/release the payment of maturity amount i.e. Rs.3,50,000/- alongwith interest @9% per annum from the date of filing of complaint till  realization. We direct the OPs to pay to the complainant an amount of Rs.3500/- being compensation on account of mental pain agony and harassment and Rs.1500/- as litigation expenses.

6.             This order of ours shall be complied with  within 60 days from the receipt of copy of the order.  Copy of the order be supplied to the parties free of charge. File be consigned to records in due course.                   Announced
