Complainant’s case in brief is that she is running a shop at Gomia in which Electric connection is in her name and she is using only two bulb, one fan and one fridge. Further case is that her usual electric consumption was in between 32 to 50 KWH and on 18.09.2018 total meter reading was 1673 kwh but suddenly on 22.11.2018 reading has been shown 10108 kwh in this way one month’s electric consumption has been shown 8435 kwh inspite of only use of above mentioned electric equipments. Further case is that complainant has made compliant before the O.P. regarding meter reading but it has been shown by inspection report of the meter dt. 25.01.2022 that there is no defect in the meter. Further case is that reading of one month’s consumption 8435 kwh is unnatural rather it is due to defects in the meter but inspite of repeated requests defect has not been removed. Hence it is prayed to wave the amount of electric bill dt. 22.11.2018 Rs. 53,666.59/- and restore the electric connection and further to pay Rs. 50,000/- as compensation and Rs. 15,000/- as litigation cost.
As per W.S. of the O.Ps. concerned electric meter was found in order after its test by the expert and all bills have been issued as per meter reading. Hence it is prayed to dismiss the case.
Point for consideration is that whether complainant is entitled to get relief as prayed ?
To prove its case complainant has filed photo copy of application dt. 29.11.2018 filed before the O.Ps. (Annexure-A), photo copy of bill dt. 22.11.2018 issued by the O.Ps. (Annexure-B), photo copy of previous payment receipts regarding payment before the O.Ps. (Annexure-B), photo copy of meter testing report (Annexure-C) and photo copy of reply of RTI (Annexure-D). Except above mentioned papers no any other documentary evidence has been produced by the complainant.
Complainant has examined herself as witness and has produced her evidence on affidavit who states during cross- examination that on examination by the expert of electricity department meter was found in order. However she has self stated that meter was jumped.
Though it is alleged by the complainant that there is jump in the meter but there is no any specialist/ technical expert’s examination report to show that meter was defective. Contrary to it there is expert’s opinion on examination of the meter concerned that it was in order.
Therefore, in light of above discussion we are of the view that complainant is not able to prove her case related to defect in the meter for grant of relief as prayed. Accordingly this case is being dismissed with cost.
