ORDER

Judgment/Order:

The brief of the case is that Smti Yane Komut  PMRY beneficiary opened Ice Cream parlor T Tasubg building near Pane river, Pasighat. She apllied to power dept.,Pasighat Elect. Division for separate (Spl) power line to power line to her Ice cream shop for using deep freezer. After fulfillment of all formalities for separate line connection for applicant, the power department provides separate line of electricity to her Ice cream shop and was running her shop smoothly. But the power dept had suddenly cut off said separate line on 27th July 2005 without prior notice to the consumer which caused heavy loss to the Ice cream shop of Smti Yane Komut and bound Smti Komut to complaint to the President dist. Forum Pasighat for redressal of her grievances.

            Under section 13 of the consumer protection Act 1986, the president, Dist Forum issued 30 days notice to the opp. Party to give his version of the case. After expiry of 30 days the Forum summoned both the parties and heard the case but couldn’t decide due to shortage of evidences, absent of one of the parties & for technical problem etc.

            On this 25th Oct’07 same case has been heard & judged as per evidence of the case.

PMRY scheme is a central govt’s sponsored scheme for self employment of educated youths. As per consumer protection Act1986, goods purchased or service availed for the purpose of earning livelihood by way of self employment will not regarded as commercial purpose. So, complainant is identified as a genuine consumer.

1)It has been observed from evidence that consumer get separate connection electricity line after fulfillment of formalities like deposited security money and she has been paying monthly rent regularly. No faults are found on the part of complainant.

2)According to section56 sub section(1) of the electricity Act’s 2003 the department is to issue not less than 15 days period of notice to consumer before disconnection of the line.

Moreover, according to section 43,sub section(3) of the electricity Act 2003 the dept. shall be liable to penalty of Rs.1000/-(Rupees One thousand) only for each day of default from which the cause had taken place, But cause and evidence regarding disconnection are not found. So, negligence to the consumer on the part of department, Electric Division, Pasighat is established.

The complainant claim recovery of lost amount from power department as under:-

  1. Expenditure for separate line such as security money cost of accessoriesRs24950/-
  2. loss value of Ice cream product with transportation charge                 Rs.119500/-
  3. being the penalty for default of power line for 400 days                       Rs.400000

    @ Rs.1000/- per day

4. Compensation due to mental injury                                                       Rs. 50000/-

                                                                                               Total                   Rs.594450

                        (Rupees Five lakhs Ninety Four thousand four hundred fifty) only

Considering consumer’s mental injury and financial loss due to clear breach of electricity Act by the power department Pasighat, this dist Forum passes the following order.

 1. Power Department Pasighat Electrical Division           Rs. 200000/-

   Pasighat shall pay to consumer a Lump-

  Sum of amount of Rs.200000/- Rupees two lakhs) only

  Out of claimed amount of /rs 594450/- without calculating interest of the amount

2. Awarded compensation for mental injury.                         Rs 25000/-

3. Power Dep. Pasighat shall pay Rs.225000/-

(Rupees two lakhs twenty five thousand)      

                                                                     Total             Rs. 225000/-

Only to Smti Yane Komut within #0 days of issue of this order.
