PER SHRI. S.M. RATNAKAR - HON’BLE PRESIDENT  :

1)         The Complainant has filed this complaint against the Opposite Parties who are having their offices outside the jurisdiction of this Forum.  As per the provisions of Sec.11(2)(a) of the Consumer Protection Act, 1986, the Complainant is required to file the present complaint having jurisdiction to try the complaint against the Opposite Parties. The Opposite Party No.1 is carrying on its business at Mulgaon, MIDC, Andheri (E), Mumbai – 93, and the Opposite Party No.2 is carrying on its business at New Delhi.  The documents placed on record by the Complainant at Annexure -‘1’ shows that the Complainant’s address is also shown as Tahera Towers, Opp. Metro Hotel, V.P. Naka, Bhiwandi, Dist. Thane.  We thus, find that the initial cause of action for this complaint appears to have been taken place outside the jurisdiction of this Forum. Thus, the complaint is required to be returned to the Complainant for presentation of it before the proper Forum. The complaint is accordingly disposed off.  The Complainant at liberty to file the present case before the proper Consumer Forum.  Original complaint and copies of the documents be returned to the Complainant for presentation of the same to the proper Forum.

                      1)  The Complaint No.249/2014 is dismissed at the stage of admission for the want of territorial jurisdiction. The Complainant is 

                           however, at liberty to file the compliant having proper jurisdiction to entertain the compliant.
