Final Order

On 05.03.2018 the Dhr has filed a photocopy of the judgment passed by the Hon’ble SCDRC in the first appeal No-A/1420/2014 dated 06.02.2018.

Be it mentioned that being aggrieved with the order and judgment passed by this Ld. Forum in the Consumer Complaint No-138/2014 dated 24.11.2014 the O.P.s have preferred the above mentioned appeal.

The Hon’ble SCDRC has been pleased to allow the said appeal in part setting aside the order dated 24.11.2014 passed by this Ld. Forum in the C. C. No-138/2014. The Hon’ble SCDRC has also been pleased to mention in the order that the complaint case is remanded to the Ld. District Forum for adjudication afresh after allowing liberty to the complainant to implead theTreating Doctor and the Radiologist concerned in the complaint case. Both parties were directed to appear before this Ld. Forum on 06.03.2018.

Keeping in view of the above mentioned judgment of the Hon’ble SCDRC the present execution application has lost its force as the Hon’ble SCDRC has been pleased to set aside the impugned order passed by this Ld. Forum out of which this execution application has arisen.

Hence, it is ordered, that the E.A. being No-17/2015 is hereby rejected having no merit without any cost.

Be it mentioned that this record need not be placed before the Bench on 23.07.2018.

Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
