3.       FedEx Express Transporation and Supply Chain Services Ltd., 8^th Floor, Unit No.801, Boomerang, Wings A & B1, Chandivali Farm Road, Near Chandivali Studio, Andheri (E), Mumbai, Maharashtra-400072.

4.       FedEx Express Transporation and Supply Chain Services Ltd., # 558, Second Floor, Sector 20-C, Chandigarh, through its authorized signatory.

COMPLAINT UNDER SEC. 12 OF THE CONSUMER PROTECTION ACT, 1986.

Present:       None for the complainant.

                    Op No.1 already ex-parte.

Ms.Vishakha Sharma, Adv., for the Op No.3.

                  

                   Today the case was fixed for furnishing fresh address of the Ops No.2 and 4. Perusal of the file reveals that on 10.10.2017, service of the Ops was completed and counsel for the Ops sought time for filing written statement and the case was adjourned to 27.10.2017 for filing written statement of Ops. On 27.10.2017, counsel for the Ops has filed her vakalatnama on behalf of the Op No.3 and sought time for filing written statement vide a separate statement and the case was adjourned to 06.12.2017 for filing written statement of Op No.3 alongwith entire evidence and the compalnant was directed to furnish fresh address of Ops No.2 and 4. On 06.12.2017, counsel for the Op No.3 has filed and application for adjournment and on the request of the counsel for the Op No.3, case was adjourned to 14.12.2017 for filing written statement of Op No.3 subject to costs of Rs.1000/- and the complainant was again directed to furnish fresh address of Ops No.2 and 4. On 14.12.2017, due to lack of quorum, case was adjourned to 18.12.2017 for further proceedings. On 18.12.2017, cost of Rs.1000/- was paid and written statement was also filed but due to non appearance on behalf of the complainant, copy of written statement was not supplied and the case was again adjourned to 27.12.2017  and for today i.e. 10.01.2017 for furnishing fresh address of Ops No.2 and 4. Today again there is no appearance on behalf of the complainant. Case called several time since morning. It is already 4 PM. But none has appeared on behalf of the complainant. It appears that the complainant is not interested in pursuing the matter any further. Since the complainant has not turned up. So, this complaint is dismissed for want of prosecution on behalf of the complainant. We order accordingly.

                   A copy of this order be sent to the parties free of costs and file be consigned to record room after due compliance.
