Sama Rangappa & others ) ORDERS This is a complaint filed under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite parties to repay deposit of Rs.20,000/- dated 17.08.2000 and deposit of Rs.40,000/- dated 18.09.2000 with interest and costs, etc. 2. It is alleged in the complaint that the complainant deposited Rs.20,000/- on 17.08.2000 and deposited Rs.40,000/- on 18.09.2000 with Earth Movers Employees Credit Co-operative Society Limited, Kolar repayable for a specific period with interest and it is alleged that evenafter the maturity of deposits the OPs failed to repay the deposits and interest inspite of repeated demands. 3. The OPs appeared and filed version. They admitted the receipt of deposits as alleged. They contended that interest has been paid on both the deposits upto 31.03.2005 and the complainant has failed to disclose the receipt of interest by OPs. They prayed for six months time to repay the deposit and the subsequent interest. 4. During the arguments the complainant who was present in person along with his counsel admitted that interest has been received up to 31.03.2005. The Learned Cousel for OPs submitted that as in other similar cases interest may be awarded at 7% p.a. from 01.04.2005 in view of the financial difficulty of the said society. 5. In view of the above facts we pass the following: O R D E R The complaint is allowed with costs of Rs.1,000/-. The OPs shall pay Rs.60,000- (rupees sixty thousand only) to complainant with interest at the rate of 7% p.a. from 01.04.2005 till the date of payment, within 45 days from the date of this order Dictated to the Stenographer, corrected and pronounced in open Forum this the 08th day of January 2010.
