JUDGMENT
Complainant has filed the consumer complaint U/S 35 of Consumer Protection Act, 2019 seeking to exempt the penal assessment amount of Rs.21,957/- and sought compensation and not to disconnect the power supply.
Complainant being aggrieved by the imposition of penalty U/S 135 of Electricity Act has filed the consumer complaint. As per the settled position of law in the case State of U.P. Power Corporation Limited Vrs. Md. Anis Ahemad, Consumer Commission are not empowered to entertain any application U/S 126, 135- 140 of Electricity Act.
Brief fact of the case is that opposite parties have imposed fine/penalty/bill of Rs.21,957/- on complainant for parallel hooking U/s.135 of Electricity Act.
We have no power to adjudicate the dispute with regard to any proceeding U/s.126, 135- 140 of Electricity Act.
But the complainant who is a consumer prayed that he is a rustic villager and has no resources to go to various lawyers and Courts and prayed to settle the dispute.
Keeping in view the limited prayer and taking a lenient view, we direct the opposite parties to settle the grievance of complainant by deducting 40% of the bill as is being deducted normally by the opposite parties, which the complainant shall pay in 04 installments and shall pay regular bill. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
