ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                               JUDGMENT

            Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite parties to not to disconnect the power supply and pay compensation Rs.20,000/- towards deficiency of service”.

            In the present consumer complaint the matter relates to Section 135 of Electricity Act in which Consumer Commission has not power to entertain in view of the decision of Hon’ble Apex Court in the case of U.P. State Power Transmission Corporation Vrs. Md. Anis Ahmed.

            Keeping in view the above settled position of law as well as taking into consideration the plight of complainant we take a lenient view and direct the opposite parties to deduct 40% as is being normally deducted by opposite parties and settle the dispute and shall allow the complainant to pay in 06 monthly installments along with regular bill. If the complainant prays to install new meter the same shall also be considered by opposite parties and install a new meter on payment of required fees. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
