ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                     JUDGMENT

            Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking a direction for new connection to his newly constructed building over Plot No.3425, Ac.0.08 Dec. under Khata No.265 of Mouza Mandasahi.

            The opposite parties have filed objection stating as under;

            The new connection is processed through online mode of Mo-bidyut portal. Through 4 stages application registration is getting completed as i) Verify Mobile No., ii) Fill application, iii) Upload Document, iv) Make payment, v) Fill Application- On web site in Sl. No.6 its displaying “Is there connection already exist in premises (Yes/No). Applicant has selected No. Applicant has provided false information to the Government Portal for which portal has taken the applicant to payment gate way else portal would have not process the application to payment gateway.     

            From the objection it is revealed that there is pending due of Rs.22,158/- on the brother of complainant for which the opposite parties have not provided the connection. We found from Sec.17 of OERC Code Sub- Clause (i) there is no agreement with the spouse, son, daughter and parent or in the name of company with whom complainant is associated but there is connection in the name of his brother which is not coming within the purview of Sec.17(i) of OERC Code as stated above.

            We therefore direct the opposite parties to provide electric connection to complainant immediately and opposite parties are free to recover the bill from his brother in accordance with rule/law. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.

            Pronounced in the open Commission on this 17th May,2024.
