ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;
“Direct the opposite parties not to disconnect the electric current to the house of the complainant bearing consumer No.04402812 pay Rs.20,000/- towards mental agony, Rs.10,000/- towards cost of the litigation and Rs.50,0000/- towards physical suffering”.
The brief fact of the case is that, the complainant being very poor and the electricity was connected vide consumer No.04402812 under Soubhagya Yojana Scheme. On 15.7.2020 the opposite party No.3 illegally demanded connection charges, it is to be mentioned the Government of India as well as State Government provide the electric connection, affix the meter with free of cost under Soubhagya Scheme. Since the super cyclone 1999 neither the husband of the petitioner nor her father-in-law consumption any current as the complainant and her husband resided outside and after allotted a house under government scheme, completion of said house, the complainant being the poor and as per government scheme she is eligible for the benefit for the electric connection and the opposite party No.3 with an ill intention on 15.7.2020 orally given threaten to disconnect the electric connection.
Notice was issued to opposite parties but none has appeared and the opposite parties have been set ex-parte on 06.5.2022.
There is no material filed by complainant to substantiate the claim made by her in her petition. On mere apprehension and threatening the case has been filed which is premature and no cause of action arises. The complainant shall pay the bill regularly and the dues as admissible under the rules and the opposite parties shall not disconnect the electricity without due notice and opportunity of being heard. With the aforesaid observation and direction consumer complaint is disposed of. No cost.
