ORDER

                                                                                                JUDGMENT

 

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking the following reliefs:

            “Direct the opposite parties to reduce the excesses bill and revise the bill as correct and wave out Rs.1,000/- of fine and not to disconnect the power supply to the premises”.

            Brief fact leading to the case is that complainant is a domestic consumer under opposite parties since 1988 bearing consumer No.03115715 the meter was found defective in the year 2008 and the opposite parties collected on average basis up to 2010. Again the meter was found defective from 2014 to 2016 as such one notice dtd.20.12.2019 was issued U/s.56 (1) of I.E. Act, 2003 stating therein the outstanding amount of Rs.5,891/-. Challenging the said notice complainant filed this consumer complaint.

            Notice was issued to opposite parties on 18.01.2020 by Regd. Post, but they have failed to appear and were set ex-parte on 02.11.2021.

            We have heard the counsel for complainant and perused the materials available on record. Since the meter was defective and the amount imposed is challenged by the complainant and the opposite parties are absent. We think it just and proper to remand the matter to the opposite parties to settle the claim by deducting some amount as permissible under the rules as per their status and capacity to reduce the amount from consumer, or in the alternative install a new meter and on the basis of six monthly bills, the amount for the period from 2008 to 2010 and 2014 to 2016 may be decided. With the aforesaid observation and direction the consumer complaint is disposed of, without any cost.
