JUDGMENT

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;

            The brief fact of the case is that the complainant’s is a consumer and consumed electricity under the CESU/Enzen vide consumer No.000003564483 since the year 1982. The Complainant was paying monthly electricity dues as per meter reading and as per bill regularly. Being senior citizen the couple is very often went to their children who lived in Bhubaneswar every month. The connecting load of the complainant was at best 1k.w but the opposite parties issued bills indicating load connection indicating 1k.w. and somewhere 2k.w as per their own accord issued inflated bills beyond the consumption by the complainant. The opposite parties indicated bills even supper cyclone period in 1999, Filine, Hoodood, Funny when there was none supply of current. Several times the complainant has approached the opposite parties to revise his bills taking in to account as 1k.w as connection load and waive out the amount during the non supply of current period but the opposite parties did not listen to him. On 20.12.2019opposite parties has issued a notice demanding Rs.49,213/-from the complainant and threatened that if he did not deposit the amount then they  disconnect the power supply. The cause of action arose when on 12.2.2020 the opposite party No.4 (Junior Manager, the then Enzen Global Solution) came to the premises of the complainant and threatened to disconnect the power supply. Hence this complaint.

            Notice was issued to opposite parties on 14.2.2020 by Regd. Post but none of parties responded the notice of this Commission. In spite of Notice to the opposite parties never responded and was set ex-parte vide order No.14 dated 15.3.2021 as the notice was sent in the correct address with postage prepaid for which notice was deemed to have been sufficient on the opposite parties as the opposite parties preferred not to appear they were set ex-parte and the Commission proceeded to dispose off the case.

            The opposite parties without correcting the electric bill as per the load factor of 1k.w of the complainant and during the no electricity period i.e. supper cyclone period, Filine, Hoodood, Funny impose fine of Rs. 49,231/- is illegal arbitrary, whimsical and non application of mind for which we quash the notice/enhanced bill imposing arrear of Rs.49,231/- and direct the opposite parties not to disconnect the electric line to the complainant and issue correct bill in favour of the complainant. With the aforesaid observation and direction the consumer complaint is disposed of without any cost.
