The present complaint has been filed by the complainant on the averments that the complainant made a complaint to the OP on 15.7.2022 regarding plot No.C-80, Fateh Nagar, New Delhi of which the complainant is a co sharer and the plot is amalgamated one as per record. The complainant deposited Rs.100/- in the form of IPO No.53H501897 dated 15.7.2022. It is further averred that the complainant in his complaint to the OP has sought public documents under Section 76 of the Indian Evidence Act and not under RTI. The detail of the documents demanded by the complainant is listed a to j in the complaint. However, due to non comply of the document by the OP, the complainant approached this Commission with a prayer to supply the certified copies of public documents along with compensation of Rs.80,000/- and cost of litigation as this Commission deems fit.
2. Upon notice, the OP has choosen to remain exparte vide order dated 01.03.2023.
3. In support of his version, the learned counsel for the complainant has placed on record certain documents and has closed his evidence.
4. We have heard the complainant in person and have gone through the documents placed on record by the complainant, minutely.
5. From the perusal of the documents placed on record by the learned counsel for the complainant especially Ex.C3, (File No.SR-II/BDP/Misc/2022/2246 dated 31.8.2022), a letter from the OP to the complainant. The operative part of which is reproduced as under:-
“With reference to your letter dated 15.7.2022 received in this office on 22.7.2022 on the above cited subject. In this regard, it is to inform you that you may apply for certified copy of the document in this office from Monday to Friday on any working day between 10.00 AM to 01.00 PM and gets the certified copy of your requisite documents as per Section 57 of the Registration Act, 1908 (Ex.C3)”.

In view of above, the complaint of the complainant stands disposed of accordingly with the directions to the complainant to visit the Sub Registrar-II-Basai Darapur, New Delhi on any working day i.e. from Monday to Friday between 10.00 AM to 01.00 PM and get the certified copy of your document as per Section 57 of the Registration Act, 1908 (Ex.C3). Free certified copy of this order be supplied to the parties, as per rules. The file be indexed & consigned to the Record Room.
