Briefly case of the complainant as stated is that he is consumer of water of Delhi Jal Board here in the opposite party vide meter no.NA0235. The opposite party was in habit of raising illegitimate water charges bills. Family members of the complainant were paying the bills regularly. One day the complainant checked the previous bills and found irregularities in the bills. Therefore, the complainant filed an application under RTI Act. The complainant is not satisfied by frivolous and fake reply of the opposite party.
The opposite party from 17.02.12 to 16.05.12 raised bill of Rs.3,787/-, from 16.05.12 to 28.12.12 of Rs.16,446/-, from 28.12.12 to 0.03.13 of Rs.499/-. The opposite party raised bill from 06.03.13 to 31.07.13 for sum of Rs.1,078/-, Rs.1,078/- and Rs.1,130/- thrice.
The complainant has paid bills no.023546455729 and 023544384645 for the periods from 12.02.13 to 06.03.13. He also paid bills from 06.03.13 to 31.07.13. Therefore, bill no.023545460878 for the period from 12.02.13 to 16.04.14 of Rs.7,850/- be cancelled and new bills for the period from 01.08.13 to 16.04.14 be raised after adjusting Rs.7,850/- the amount paid. The complainant several times asked the opposite party to refund Rs.4,914/- of the excessive water charges but to no effect. Hence, the present complaint for direction to the opposite party to refund Rs.4,914/- of the excessive water charges received and pay Rs.10,000/- for mental torture and harassment.
Notice of the complainant was given to the opposite party. But despite service non appeared on behalf of the opposite party. Therefore, the opposite party was proceeded against exparte vide order dated 08.10.15.
When Shri Om Prakash complainant was asked to lead evidence, he filed affidavit dated 11.02.16 narrating facts of the complaint. He also relied upon copies of letter no.181 dated 30.06.15, application under Section 5 of the RTI Act with information received from the opposite party, bill no.023545460878 dated 08.07.14 for Rs.7,848/-, bills no.023544384645 dated 22.08.13 for Rs.1,078/-, bills no.023546455729, 023543959044, 023549542837 dated 22.08.13 for Rs.1,078/-, bills no.023543959044, 023549542837 dated 14.03.13 for Rs.499/- and bill no.023549542837 dated 26.01.13 for Rs.5,822/-.
We have heard the complainant and have gone through the records carefully and thoroughly.
The grievance of the complainant is that the opposite party has been raising excessive water charges from the opposite party from 07.02.12 till 16.04.14. But except the complaint and affidavit of complainant there is nothing on the record that the opposite party has been charging excessive water bills from the complainant. Whereas from perusal of the reply under Right to Information application of the complainant and bills it reveals that the opposite party has been charging water charges from the complainant according to his consumption. The complainant has been paying the bills regularly without any objection. Therefore, the complainant has to failed to show that there is any unfair trade practices are deficiency in service on the part of the opposite party. Therefore, there is no merit in the complaint. Hence, the complaint is dismissed.
