Learned counsel for the petitioner states that the consumer complaint of the respondent is liable to be dismissed on the ground that insurance policy was obtained by making misrepresentation, yet the petitioner Company is ready to refund the insurance premium of Rs.50,000/- to the respondent Complainant as ex-gratia payment provided he is ready and willing to withdraw his complaint. Ms. K. Radha, Advocate for the respondent complainant accepts the offer and withdraws the consumer complaint. In view of the above, impugned order is set aside and the revision petition is disposed of in terms of the compromise. Petitioner is directed to refund the premium amount of Rs.50,000/- to the respondent complainant within two weeks from today, failing which the amount shall carry interest @ 12% p.a.
