Today is fixed for showing cause as to why the case shall not be dismissed for non-compliance of the order of the Forum, by the complainant.

The O.P. files hajira but none appears from the side of the complainant on repeated calls. It is now 02:10 pm.

On scrutiny of the record it appears that on 10.02.2014 by passing a specific order, this Forum made a direction to the complainant to give the answers of the questionnaires submitted on behalf of the O.P. fixing on 03.03.2014 for answer. On 03.03.2014 on repeated calls the complainant was found absent but for the ends of justice to give an opportunity to the complainant this Forum

fixed this day directing the complainant to show cause as to why the case should not be dismissed for non-compliance of the order of the Forum. From the record it further appears that after passing of the order on 03.03.2014 from the side of the complainant a petition praying for time to give the answer of the questionnaires was submitted but the said petition was not moved by the complainant and accordingly the petition was kept with the record.

Today the complainant has failed to appear before this Forum and from his side show cause as per order dated 03.03.2014 and the answer of questionnaires as per order dated 10.02.2014 have not been submitted.

The conduct of the complainant shows that the complainant has lost his interest in this case and he deliberately has not complied with the directions of this Forum.

In the premises there is no other alternative but to dismiss the case.

Hence, it is

ORDERED,

that the complaint case No. CC-79/2013 is dismissed for non-compliance of the order of the Forum without cost.

The case is thus disposed of on dismissal.

Let a true copy of this order be sent to the complainant through registered post acknowledgement due and a true copy of this order be supplied to the O.P. free of cost.
