Order No.07
20.08.2015
Today is fixed for filing show cause by the complainant and passing necessary order. The contesting O.Ps. filed their haziras. On behalf of the complainant a petition praying for time to file show cause, has been filed.
We carefully perused the previous orders passed in this case and contains of the petition filed by the Ld. Advocate of the complainant. It appears that the complainant is absent since after filing this complaint though in some occasions on behalf of the complainant hazira has been filed by his Ld. Advocate. On 30.6.2015 on behalf of the complainant no steps was taken and on repeated calls none appears from the side of the complainant and as such complainant was directed to show cause as to why the case shall not be dismissed for his non-appearance. The Ld. Advocate of the complainant in the petition has clearly stated that he tried again and again to make contact with the complainant using the phone number which was supplied by the complainant. It is the duty of the complainant to make contact with his Ld. Advocate, if he is interested in respect of this case. The conduct of the complainant clearly shows that he has lost his interest in this case. So, we find nothing to proceed with this case further and also we hold that there is no alternative but to dismiss the case.
Fees paid is correct. Hence, it is
Ordered
that the petition dated 20.8.2015 filed by the Ld. Advocate for the complainant is rejected and C.C. No.91/2015 is dismissed for default without any cost. Let the copies of this order be supplied to the each party free of cost.
