Complainant is present. Today is fixed for admission hearing. Heard the Complainant. The case of the Complainant in short is that the Complainant and Nimai Nandi the partner/prop. of Durga Brick Field made an agreement on condition that Mr. Nimai Nandi would supply of 3000 number brick to this Complainant for which he received Rs. 15,000/- only from this Complainant from his house on condition that supply of Brick will be made in the month of Falgun but he did not supply the brick to the Complainant. From the materials on record we find that in respect of the we find that the payment of Rs. 15,000/- was made to the OP on 14.11.13 by the Complainant. So, it is clear that more or less ten years have lapsed since the date of cause of action. Thus the instant case is liable to be dismissed on the point of limitation. Hence, it is ORDERED that the instant case No. CC/13/2023 is not admitted and as such it is dismissed on the point of limitation. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
