BEFORE THE DISTRICT CONSUMER DISPTUES REDRESSAL FORUM, YAMUNANAGAR AT JAGADHRI.

Present:      Sh. Tarun Rohilla, Adv. for the complainant.

                   Op No.1 already exparte.

                   Sh. Sumit Gupta, Adv. for the OPs.No.2 & 3.

                  

                   File taken up in Lok-Adalat.  The matter settled amicably.  Ld. Counsel for the Ops No.2 & 3 has made a statement that the issue involved has been compromised and as per compromise, the Ops are ready to refund the 70% (i.e.Rs.10,080/-) of invoice amount of the disputed mobile set after deducting 30% as depreciation within 30 days, subject to the condition that the complainant shall deposit the old mobile handset alongwith the accessories in the Service-Centre of Ops and the mobile set should not be in broken condition or water logged.

                  On the other hand, ld. Counsel for the complainant made a statement that in view of the statement made by ld. Counsel for the Ops No.2 & 3, he does not want to proceed with the present complaint further and thus, withdraws the same.  Ld. Counsel for the complainant requested that the cheque in question may kindly be issued in favour of complainant-Mukesh Singla.  The Ops are directed to issue the cheque of Rs.10,080/- in favour of complainant-Mukesh Singla.  So, in view of statement of ld. Counsel for both the parties, the present complaint is hereby dismissed as withdrawn being compromised.  Both the parties are bound by their own statements.  File be consigned to record after due compliance.
