ORAL ORDER

Per – Hon’ble Mr. S. R. Khanzode, Presiding Judicial Member

           Heard Adv. Uday B. Wavikar on behalf of the Applicant/original Appellant.  This application needs to be taken as the one requiring no judicial inquiry (similar to Civil Court side ‘C’ Application requiring no judicial enquiry).   Appeal No.968 of 2010 stood disposed of by an order dated 21/6/2013.  This application is moved to correct the title – description of the appellant in the said order.  It is stated that instead of ‘Mysore Silk International Ltd.’, it should be ‘Mysore Sales International Ltd.’ as described in the original complaint from which the appeal arose.

 [2]     Said appeal was decided by the Bench of myself and Shri S. B. Sawarkar, the Member.  Hon’ble Mr. S. B. Sawarkar is no more available since he has resigned from the assignment.  The complaint was filed by ‘Mysore Sales International Ltd’.  However, in the appeal memo itself the name of the Appellant is mentioned as ‘Mysore Silk International Ltd’, as stated at the Bar.  Thus, the order is in conformity with the description as mentioned the appeal memo.  Under the circumstances, unless the title in the appeal memo itself is got corrected, there arises no question of correcting the description Appellant in the order.  Hence, the miscellaneous application stands rejected and stands disposed off, accordingly.
