BY SRI. KRISHNANKUTTY N .K, MEMBER.
1. Pleadings of the complainant.
The complainant sent a package containing certain valuable documents on 14.11.2023 to his daughter in Slovakia through the first opposite party. The complainant paid Rs.4,200/- as courier charges. The allegations of the complainant are;
a) The OP1 sent the package through the 3rd opposite party though the charges collected was for DHL Courier Service.
b) Though the package reached Kolen in Germany on 16.11.2023 as per the tracking number given by the 1st opposite party it never reached the addressee in Slovakia.
c) The lost documents were to be submitted to the Slovakian authorities for allocation of residence permit to his daughter. As the documents were lost, she lost the opportunity to submit the document before the cut off date to get residence permit for Slovakia.
d) Though the complainant had confirmed the value of shipment as Euro 5800, the 1st and the 2nd opposite parties have reduced the claim amount to Rs.2000.44.
Aggrieved by this, the complainant approached this Commission seeking a relief of Euro 5800/- along with other expenses required to get the residence permit.
2. Notices were issued to the opposite parties. Notice to the 1st opposite party was returned with endorsement “unclaimed”. They did not enter appearance and hence was set ex-parte. Notice to the 2nd opposite party was delivered on 27.01.2024; but they did not file version within the statutory period and hence, was set ex-parte. As the notice to the 3rd opposite party was returned undelivered, the complainant was directed to produce the E-mail id of the 3rd opposite party.
3. As the complainant failed to attend the proceedings of the case since beginning and to take any further steps in the matter, the case was taken for orders based on merits.
4. From the lack of interest shown by the complainant in conducting the case, it can be presumed that he is not inclined to peruse the case.
5. Hence the complainant is dismissed. The complainant is not entitled to any reliefs.
Pronounced in open court on this the 6th day of May, 2024.
