This C.C having been heard on 19.01.2016, the Forum on 29.02.2016 delivered the following:

ORDER

SMT. LIJU B. NAIR:  MEMBER

Complainant’s case is as follows:  He booked a courier in favour of one Mr. Gopinath of Nagercoil through 2^nd opposite party on 09.02.2015.  He was given assurance that the same will be delivered to the addressee on 11^th of February.  But when he enquired on 11^th with the addressee, he has not received the parcel.  Again the complainant approached the 2^nd opposite party and enquired about the same.  He was told that it reached Nagercoil and will be delivered soon.  At last it was delivered to the addressee only on 13.02.2015 by 5 pm.  So for the delay and mental stress, complainant claims compensation. 

Notice was sent from this Forum to the opposite parties.  But they failed to appear and we proceeded exparte against them.

Points raised:

1. Whether the allegation against the opposite parties is proved?
2. Reliefs and costs if any.

Points (i) & (ii):- Complainant filed affidavit along with the copy of the courier receipt which was marked as Ext. P1.    Perused the document and heard the party.  There is nothing on record to disprove the allegation of the complainant.  So we are allowing the complaint. 

In the result, complaint is allowed.  Opposite parties are directed to pay the complainant Rs. 1,000/- (Rupees One thousand only) as compensation within 2 months of receipt of the order failing which the amount will carry interest at the rate of 6% till the date of realization.  No order on cost. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
