None for complainant.

Sh.B.S.Walia, Counsel for Opposite Party (OP).

PER RATTAN SINGH THAKUR, PRESIDENT

  1.         Per allegations of the complainant, she had sent a medicine through courier i.e. opposite party on 17.04.2017 to her son at Bengaluru. The article was delivered to the representative of opposite party within a territorial jurisdiction of this Forum. It is alleged that the delivery of medicine was of urgent nature, but it was delivered late. Hence, this complaint.
  2.         Opposite Party appeared and filed reply to the complaint. Opposite Party themselves have produced on record that parcel was received by them on 17.04.2017 and was delivered on 10.05.2017 i.e. after 23 days.
  3.         We have gone through the record and heard the arguments addressed by the counsel for the opposite party.
  4.         In the present case, apparently there seems to be abnormal delay in delivery of article. In normal course, more than 5-6 days time ought not to have been taken for delivery. The case of the complainant is that medicine being urgent in nature to be delivered to her son. Keeping in view of the aforesaid aspect, there is deficiency in service/negligence. Therefore, we award a compensation of Rs.1500/- payable by opposite party to the complainant within a period of 30 days from the date of receipt of copy of this order, failing which the awarded amount shall carry interest at the rate of 9% per annum from the date of order till payment is made to the complainant. This complaint stands disposed of accordingly.
  5.         The certified copy of this order be sent to the parties free of charge. The file be consigned.
