ORDER
The instant complaint is filed by Anil Kumar (hereinafter referred to as the complainant) against DRM, Northern Railway and another (hereinafter referred to as the OP/s) under the Consumer Protection Act ( for short the Act).
The averments of the complainant are that he booked railway tickets with Indian Railway from Faridabad to Rajpura for journey through Chhattisgarh Exp. The train was boarded from Faridiabad Railway Station on 15.12.2022 at 19:03 and complainant with his family members started journey to Rajpura. When the train crossed Nizamudin Railway Station suddenly one unknown person entered the reserved coach S3 and snatched the mobile phone of the son of complainant. Complainant lodged DDR with GRP Railway police, Rajpura but no action has been taken.
Grievance of the complainant is that he booked the tickets in reserve coach for the safe journey of him and his family but due to negligence on the part of Railway, no security person/police or TTE has looked after the rights of the passengers as a result of which unknown persons freely entered the reserved coach without any fear, which is clear cut deficiency in service and unfair trade practice on the part of the OPs. Consequently, prayer has, thus, been made for acceptance of the complaint.
Complainant has alleged that miscreants snatched the phone from his son when he was sitting at seat No.5 in coach No.S3 of the train and has alleged deficiency in service on the part of OPs.
We are of the opinion that any luggage or personal belongings of the complainant/passenger are to be looked after and protected by the complainant himself. The OPs can be held responsible only in case the seat which was reserved by the complainant was not provided to him or the other facilities like A.C., lights etc. were not working or the food etc provided by the OPs was stale or not up to the mark. The complainant cannot take the benefit of his own wrongs as he has failed to protect his mobile phone and cannot shift the onus of the same on the OPs. The complainant has also lodged an FIR for the said incident and the same is under investigation with GRP. We find no merit in the complaint and the same is hereby dismissed.
