The Complainant-in-person is present today and files hazira. Heard at length and on perusal of the case record, it appears that the present complaint filed for deficiency in services under the Consumer Protection Act, 2019 against the Railway Authorities. The case of the complainant hits the principles of Fundamental Rights of citizens under the Constitution of India. The present complaint cannot be decided summarily before this Commission.
The law is well settled in O.P.Thalkur v. Shimla Municipal Corporation & Ors. reported in https://indiankanoon.org/doc/169279808/ where in Hon’ble National Consumer Disputes Redressal Commission held that, “the Consumer Protection Fora do not enforce fundamental rights and also do not exercise jurisdiction of Hon’ble High Courts or Hon’ble Supreme Court of India under Art. 226 or 32.”
In view of the above terms, the complaint is dismissed with liberty to the complainant to seek remedy in a competent court as per the law. The present Consumer Complaint stands disposed of accordingly.
