ORDER Per Mr S M Shembole, Hon’ble Presiding Member   Order below Misc. Application No.MA/08/425   None for the applicant / appellant as well as his counsel is present. Therefore this application deserves to be dismissed in default.   Adv.C N Adgokar for the non-application is present. The record reflects that this application for restoration of appeal No.A/03/860 was allowed and appeal was restored subject to payment of cost Rs.500/- vide order dtd.04.09.2008. But the record does not reflect that the applicant has complied with the same order by making the payment of cost by depositing Rs.250/- to Legal Aid Fund Account and by making the balance payment of Rs.250/- to the respondent.   Hence, this application stands dismissed.   Consequently, the appeal is rejected.   No order as to cost.   Copy of this order be supplied to the parties.   Delivered on 24.11.2011.
