ORDER

Parties file hazira. The petition dated 26.04.17 filed by the complainant for amendment of the complaint along with objection filed by the O.P No.1&2 and 3&4 separately is taken up for hearing treating the same as MA No.47 /17.

            Perused the petition, W/O, other materials on nrecord.

Heard both sides. Strong objection raised by the Ld. Advocate/Agent of the O.Ps.

We find that by proposed amendment the complainant is intending to introduce some facts in the complaint regarding death of the original complainant in NRS Medical College and Hospital on 08.06.2015 due to negligence act of the O.Ps.

We find that said facts are not new and there is reflection of such facts in the complaint and proposed amendment will not change the nature and character of the case.

However the present complainant has filed such application very late stage and prayer is to be allowed with cost to the O.Ps.

Accordingly the petition dated 26.04.2017 filed by the complainant for amendment of the complaint is allowed on contest with cost of Rs. 500/- each to each sets i.e. Rs. 500/- to the O.Ps No. 1 & 2 and Rs. 500/- to the O.Ps No. 3 & 4, totalling Rs. 1000/-.

Thus MA is disposed of accordingly.

Fix 16.02.2018 filing evidence by the complainant as last chance and payment of cost of Rs. 500/- each to each sets of the O.Ps by the complainant.
