Complainant is found absent on repeated calls. OP Nos. 2 & 3 are represented by the Ld. Advocate. On repeated calls the complainant is found absent, it is now 2 PM.

Heard Ld. advocate of OPs. Perused the record. It reveals from the record that today is fixed for filing evidence by the complainant as special chance. The complainant was also directed to pay cost of Rs. 1000/- on the earlier day for causing delay for filing evidence. It also reveals from the record that on 21.03.2024 another cost of Rs. 500/- was imposed against the complainant for filing several frivolous applications before this Commission.

Today neither the complainant is present nor he deposited the cost imposed as directed by this Commission and also did not file any evidence though today  is fixed for filing evidence as special chance.

Accordingly we are of the view that the complainant is not at all interested to proceed with this matter furthermore and that is why he did not file evidence today.

From careful perusal of the record we do not find any merit to pass any order in favour of the complainant.

Hence, it is therefore,

ORDERED

That the instant Consumer Case being in No. 77/2017  is hereby dismissed on merit.
